Abstract
Though important to defending the young nation's security, the brevity of the Emoluments Clauses belies the inability to enforce their intent and protect national security from extra-governmental influence. Until Donald J. Trump's candidacy for the Office of the President, little attention had been paid to these elements of national security, leaving an exploitable hole in the expectations of public office behavior. To overcome these shortcomings, action is necessary to strengthen their protections and enforceability, averting future crisis in the security and integrity of the nation. As important as these clauses are in protecting the security and integrity of the nation, there has been little interest in making them more enforceable and extricating party politics from that process. Looking forward to evolving the protections the Emoluments Clauses enumerate, a non-partisan process needs to be instituted to prevent events like those occurring between 2016 and 2021.
