Abstract
This report proposes a two-part economic criteria test—consisting of a Profit Protection Test and an Investment Ability Test—to help the New Mexico Environmental Improvement Division evaluate the financial "reasonableness" of mandated pollution control technologies. Rather than using rigid closure benchmarks, the framework allows regulators to set flexible, case-by-case profit-reduction breakpoints by balancing local economic impacts against environmental severity.
