Abstract
The report examines the feasibility of implementing the federal Clean Air Act noncompliance penalty program in New Mexico. Prepared by David Boldt and M. Brian McDonald of the University of New Mexico Bureau of Business and Economic Research for the Institute for Applied Research Services, the report reviews federal regulations governing noncompliance penalties, explains the economic and financial rationale underlying the program, and evaluates the administrative, legal, and technical requirements necessary for state implementation. The study describes noncompliance penalties as administrative fees designed to eliminate the financial benefits that firms receive by delaying compliance with air quality regulations.
